This Agreement governs your membership at and use of Iron Physique Gym ("Iron Physique," "we," "us," or "the Gym"), located at 1201 South Broadway, Suite 12, Rochester, MN 55904. By purchasing a membership, signing in, or using the facility, you ("Member") agree to the terms below. Please read the Assumption of Risk & Release of Liability carefully — it affects your legal rights.
Memberships are sold on the plans and rates presented at sign-up (monthly, annual prepaid, two-year prepaid, punch passes, and day passes). Recurring memberships renew automatically on each billing date using the payment method on file until cancelled in accordance with Section 2.
You may cancel a recurring (non-prepaid) membership at any time by giving 30 days' written notice to IronPhysiqueRoch@gmail.com. Your membership remains active — and billing continues — through the end of that notice period.
Assumption of Risk. Strength training, conditioning, use of free weights, machines, and other equipment, and participation in any fitness activity involve inherent risks — including serious injury, illness, or death. You voluntarily and knowingly assume all such risks, whether caused by the activity itself, equipment, the conduct of others, the condition of the premises, or otherwise.
Release & Waiver. To the fullest extent permitted by law, you release, waive, and discharge Iron Physique Gym, its owners, employees, trainers, independent coaches, and agents from any and all claims, demands, or causes of action arising out of or related to your use of the facility, equipment, or services, including claims based on ordinary negligence. This release does not apply to gross negligence or willful misconduct, or to any liability that cannot be waived under Minnesota law.
Indemnification. You agree to indemnify and hold harmless Iron Physique from claims, damages, or expenses (including reasonable attorneys' fees) arising from your acts or omissions, your use of the facility, or your breach of this Agreement.
You represent that you are physically able to participate in exercise and have no medical condition that would make use of the Gym unsafe. Iron Physique strongly recommends consulting a physician before beginning any exercise program. You are responsible for exercising within your own limits and for stopping if you experience pain, dizziness, or discomfort.
Iron Physique is not responsible for lost, stolen, or damaged personal property. Store valuables securely and at your own risk.
Personal trainers and coaches listed on our website operate as independent professionals. Coaching services, pricing, and scheduling are arranged directly between you and the coach. Iron Physique is not a party to, and is not responsible for, those independent coaching arrangements.

This Agreement is governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Olmsted County, Minnesota.
